troll would be correct. Kinda like the ass wipe in CA that's in cahoots with an attorney firm that goes all over the state suing for ADA violations

Now this is interesting: Since they included the disputed image in the court case filing, does that image now become public domain, since court filings are public domain?

According to the comments of that article, yes (which is why the article was able to display the image without fear of getting sued).

Righthaven can go to hell.  I'm all in favor of people protecting their copyrights, but Righthaven isn't doing it because they're concerned about the well-being of the LV Review-Journal, they're doing it because they found a way to make a quick buck.

Yeah, it was only a matter of time before this behavior started ivading the rest of our society...

Got this today in the SANS Institute's NewsBites newsletter

Quote
--Righthaven Claims Legal Standing to Sue After Modifying Agreement
    with Publisher
(June 24, 2011)
Righthaven has told a judge that it now has full copyright ownership over some of the content of the Las Vegas Review Journal, giving it the right to sue alleged copyright violators. Several recent decisions found that Righthaven lacked legal standing to sue for copyright infringement because it did not have ownership of the content in question. Righthaven said its agreement with Stephens Media, of which the Las Vegas Review-Journal is one publication, has been altered so it has legal standing to sue alleged violators.

Now we know what's really going on at the pool.

The basis of a copyright infringement is that LVJ would have made money from the sale of media that has been reprinted. I say BullShit.

Not that I would want to go up against any scummy lawyer but my argument would be that "old news is old news" and the so-called violation that references the LVJ could actually be construed as encouraging readers to go seek out the current articles thus encouraging LVJ readership and revenue.

Aren't people allowed to make photocopies of old newspaper articles they look up in a public library's reference section? :103-
Maybe that was always considered a copyright violation as well. :128-

Maybe it's the redistribution that's the problem?  I don't know -- I'm just throwing out an idea.

My opinion of Righthaven hasn't changed -- they're still scumbags.

This is just plain sad.....  Righthaven should be made to pay for everyone wasting time on this....

On a second note I would love to experience the death ray.    My wife is 100% Irish and our doctor said that Irish women can blow out 12 pound babies without a problem, so that being said our next trip may be to vegas!

Well as crazy as things are here in the north east
I still think it's part if the U.S.  (for now)

If I could go anywhere - it would be Texas with Florida second.

I looked at real estate in Vegas  -   The issue for me is airfare.
It's basically impossible for me to travel because of the cost.
$400 pp each way now.  With that - Vegas
Is dead to me.  (sigh)

Anyway back on topic - we should hang the
Trolls like this and Lodsys (they are going afte
Apple patents)

Quote from: SANS NewsBites Vol 13 Num. 57
--Righthaven Fined US $5,000 for Misleading Court

(July 14 & 15, 2011)

US District Judge Roger Hunt of Nevada has fined Righthaven US $5,000

for deliberately misleading the court about who would benefit

monetarily from the results of the lawsuits it was filing. Righthaven

may appeal the sanction. Also in Nevada, Judge Kent Dawson, threw out

a case Righthaven had brought against a blogger because the firm had

no standing to sue for copyright violations. Righthaven had tried to

argue that an amendment to its agreement with Stephens Media was

retroactive, allowing it to file the suit. The judge did not agree.

Score one for the good guys!

Creditor Moves to Dismantle Copyright Troll Righthaven:    http://tinyurl.com/6b4rm8h (http://tinyurl.com/6b4rm8h)

(Note, it's still not a good plan to post copyrighted articles from newspapers or magazines to this or any other site when a link to the story can be posted instead, but it's still still good news that this company and business model appears to be on its last legs.)

It just sounds like the legal scumb bags have taken all that they collected as personal fees and are going to stiff the people in the cases they lost through a corporatre bankrupcy.

Had a buddy who got picked up as teenager for carrying a crow bar. Found it in the parking lot of Dennys and instead of walking back to the car he walked into the Dennys.
The two cops walking out charged him with carrying a concealed weapon.
A. It was not concealed
B. If you ever looked at this kid (think leave it to beaver) he was far from meanacing.

It cost him 3k in legal fees to have the case dismissed. Innocent until proven guilty my a** the court system could easily break a person.
His was a simple case of two meetings and a court appearance for an underage misdemenor.

It hardly is complicated compared to an intellectual propery case like these which are costing these poor guys 150k just to say they are innocent.
I don't mind throwing NLG a note every now and again but it would be a horrible thing for Joey to endur especialliy if he did nothing wrong.
