Gun Sales Thriving In Uncertain Times

Warrenton gun shop owner Steve Clark said buyers fear restrictions on weapons that have been restricted before.

By Fredrick Kunkle
Washington Post Staff Writer

Americans have cut back on buying cars, furniture and clothes in a tough economy, but there's one consumer item that's still enjoying healthy sales: guns. Purchases of firearms and ammunition have risen 8 to 10 percent this year, according to state and federal data.

Several variables drive sales, but many dealers, buyers and experts attribute the increase in part to concerns about the economy and fears that if Sen. Barack Obama of Illinois wins the presidency, he will join with fellow Democrats in Congress to enact new gun controls. Obama has said that he believes in an individual right to bear arms but that he also supports "common-sense safety measures."

"Even though [Obama] has a lot going for him, he's not very pro-gun," said Paul Pluff, a spokesman for Massachusetts-based Smith & Wesson, which has reported higher sales. Gun enthusiasts are "going to go out and get [firearms] while they still can."

Gun purchases have also been climbing because of the worsening economy, which fuels fears of crime and civil disorder, industry sources and specialists said.

"Generally, we know that hard economic times always result in firearm sales," said James M. Purtilo of Silver Spring, who publishes the Tripwire Newsletter.

Gary Kleck, a researcher at Florida State University's College of Criminology and Criminal Justice whose work was cited in the District's recent Supreme Court gun-control case, said that although there are no scientific studies linking gun sales and economic conditions, people often buy firearms during periods of uncertainty. People often buy weapons because of concerns about personal safety or government actions to limit access to firearms, causing spikes in sales, Kleck said.

Industry experts and law enforcement officials point to several examples over the years. In 1994, there was a rush to buy guns when President Bill Clinton pushed for a ban on military-style semiautomatic rifles. Handgun sales jumped last year after the massacre at Virginia Tech as some worried about personal protection and others feared sweeping restrictions on handguns, pushing applications for concealed gun permits in Virginia alone up 60 percent. People also rushed to buy guns after the 1992 riots in Los Angeles and the breakdown of order in New Orleans after Hurricane Katrina.

Bob Leyshion, who visited a gun shop in Manassas recently, said the economic crisis and Obama's lead in the polls were on his mind.

"People are preparing for catastrophe right now," said Leyshion, 55, of Nokesville. "It's insurance. With the stock market crash and people out of work, and the illegal aliens in this area, the probability of civil disorder is very high."

Gun owners haven't been especially thrilled about the prospect of Sen. John McCain in the White House. They see the Arizona Republican as less of a threat than Obama, but they are still angry over McCain's support for certain gun-control measures in the past, such as requiring purchasers at gun shows to undergo background checks.

Gun owners said McCain's moose-hunting running mate, Alaska Gov. Sarah Palin, is far more likely to champion Second Amendment rights.

"The industry and sportsmen have not been in love with McCain, but the selection of Palin wiped that all away," said Anthony Aeschliman, a spokesman for the National Shooting Sports Foundation.

More than three dozen interviews with gun dealers and buyers in Virginia and Maryland and with experts nationwide indicated that the increase in gun sales appears to be driven predominantly by concerns about the presidential election and the economy.

Gun buyers were more likely to say they were responding to the political situation than to the economy, and all but three people said they feared that Obama would restrict gun rights. Two who indicated that they would support Obama anyway said their concerns about the economy and health care outweighed those about gun rights.

Most buyers who emphasized the economy said they thought the worsening situation could lead to an increase in crime and jeopardize their safety. A few said they were buying guns as an investment.

"Look at the political situation and the financial situation," said Fred Russell, owner of Russell's Gun Emporium in Hagerstown, Md. "It's common sense. People are scared."

Brad, 42, and Margaret Marcus, 47, who were at a Fairfax County shooting range recently with their two children for weekly target practice, said they sped up the purchase of two semiautomatic rifles that had been banned during the Clinton administration because they feared they could become illegal again if Obama wins. The couple, who run an online retailing business from their Ashburn home, said they viewed Obama's remarks about protecting the Second Amendment as campaign trail "pandering."

"I think right now people are scared Obama is going to take their rights away," said Margaret Marcus, who was carrying a Glock 19 9mm semiautomatic pistol under a blue jean jacket embroidered with "Winnie the Pooh" characters. "He's definitely anti-gun, despite what you see in the mainstream media."

Law enforcement and industry data and anecdotal reports show that guns are selling well this year. In 2008, there were 8.4 million background checks from Jan. 1 to Sept. 28, compared with 7.7 million in the same period last year, a 9 percent increase, according to the FBI's National Instant Criminal Background Check System.

The increase is also notable because it follows a heavy year for gun purchases, which industry officials and experts link to the Virginia Tech shootings in April 2007 and a burgeoning housing market crisis. NICS checks show a 20 percent increase in April 2007, compared with the previous year.

This year's jump is a continuation of a trend that began in 2006, about the time the housing bubble popped in parts of the nation, and remained steady last year as the political season began to take shape and the housing crisis grew. It is also a bigger jump than the average annual increases of about 5 percent or less typical since instant background checks began in 1998.

Federal tax data also show that quarterly excise taxes collected on sales of firearms and ammunition have increased about 10 percent this year, compared with last year, according to the National Shooting Sports Foundation.

Gunmakers see the same trend. "We're ahead of last year," said Pluff, of Smith & Wesson. "There's a few things that drive the market, and one of them is political elections."

On a recent weekend, a crowd of lookers and buyers milled around in the Virginia Arms Co. in Manassas. Some were shopping for large-capacity magazines, or clips, that attach to firearms and hold additional rounds of ammo. Those were banned during the Clinton administration and became legal again when the ban expired.

"I'm looking for gun clips because I got the funny feeling that prices are going to rise, or they're going to be banned," said Wayne Heglar, 48, who lives in Aldie and builds custom motorcycles. Heglar said he also planned to stock up on ammo.

"When the Democrats are in office, it seems like anti-gunners come out of the woodwork," Heglar said. He said he expected Obama to use tax law to restrict gun ownership. "A bullet will be a luxury," he said.

At Clark Brothers Gun Shop in Warrenton, a sign over the door says: "Experts Agree . . . Gun Control Works!" Underneath are photos of Hitler, Stalin, Fidel Castro and Libyan leader Moammar Gaddafi. There are also posters that criticize Obama's record on guns.

Steve Clark, the shop's owner, said customers have been buying weapons they fear would be restricted and that have been before, such as Colt AR-15s, semiautomatic rifles that go for $1,100.

"What I hear a lot is fear that Barack will win the election and tax everything to the point that you can't afford anything," said salesman Eugene Proko, 51.

We need to teach our youth just what a firearm can do!!

Sorry, I'm sure my opinion is slanted because of my job.
I'm just tired of picking up these kids off the street and trying to get them to the hospital in time. That's if their lucky. Usually by the time the cops have the scene secured and we can move in their's not much we can do. Usually just call them on the scene and let PD handle it.
It is a war zone in our urban streets and It's not uncommon to run two or more shootings in one night. It has a way of tearing at you after 15 years. Nothing seems to change except the faces of the kids keep getting younger and younger. Honestly I know I'm getting burned out but you run one good call where you have a save and it gives the energy to keep going back to work. Sorry, I just see the affect it has on our youth. Some try to get out of this way of life but by the time they figure it out they have a rap sheet so long no one will hire them.
Just my 2 cents on this one.

Without getting into social commentary, I believe every law abiding citizen has a right to own firearms. But here are a few things to ponder:

The purpose of fighting is to win. There is no possible victory in defense. (waiting for attack)

The sword is more important than the shield, and skill is more important than either.. The final weapon is the brain. All else is supplemental.

1. Don't pick a fight with an old man. If he is too old to fight, he'll just kill you.

2. If you find yourself in a fair fight, your tactics suck.

3. I carry a gun cause a cop is too heavy.

4.  When seconds count, the cops are just minutes away.

5. A reporter did a human-interest piece on the Texas Rangers. The reporter recognized the Colt  Model 1911 the Ranger was carrying and asked him 'Why do you carry a 45' ?  The Ranger responded, 'Because they don't make a 46.'

6. The old sheriff was attend ing an awards dinner when a lady commented on his wearing his sidearm. 'Sheriff, I see you have your pistol. Are you expecting trouble?'
'No Ma'am. If I were expecting trouble, I would have brought my rifle.'

7.  Beware the man who only has one gun. He prabably knows how to USE it!!!

8.  I was once asked by a lady visiting if I had a gun in the house. I said I did.
She said 'Well I certainly hope it isn't loaded!'
To which I said, of course it is loaded, can't work without bullets!'
She then asked, 'Are you that afraid of someone evil coming into your house?'
My reply was, 'No not at all.  I am not afraid of the house catching fire either, but I have fire extinguishers around, and they are loaded too.'

9. Having a gun in the house that isn't loaded is like having a car in the garage without fuel in the tank.

BTW Joey, how did you get video of my family reunion?????

I'm not going to go into this in detail, but I believe that all LAW ABIDING citizens should have the right to bare arms.
Taking away this right only hurts the right of LAW ABIDING citizens.
Banning guns only leaves 3 types that will have them. 1) military  2) Police 3) Criminals.

Criminals are going to get them whether they are legal or not. Most criminals get them illegally anyway.
Most of the weapons used in crimes were illegal to begin with.  Stolen, trafficked, black market, etc

No, don't get me wrong. I do believe in the right to carry a firearm. However that said, the video above with the kids firing automatic weapons is insane.
with respect, I don't agree to Joey when he responds,

"We need to teach our youth just what a firearm can do!!

Take the mystery out of it !!! "

Believe me they know what they do all to well. However they don't have the brain development to know the consequences of their use. To them is all a video game that has no reset button.
Hell why not just start them out with a beer or two.
You can take things too far and I believe the above video does just that. There are some whacked out people out there.
You have to remember that not everyone is a responsible adult.

A responsible adult would teach them so if they happen to find a gun on the street or in the play ground or find themselves in a bad situation.

They will know the do's and don'ts....  and to call 911 and do not touch..

As adults, we teach our children to look both ways before crossing the street.
We teach our children about the dangers of drugs. the dangers of strangers.

Responsible adults teach our children Gun Safety..   You say you don't Owen a gun do you know where your kids are 24/7 ???

The war on guns is every bit as effective as the war on drugs. It's funny to watch each political party try to tear down the other's logic, while trying to justify the same logic on their side.

Violent crime is a societal problem, not an inanimate object problem.

FYI, I just saw this one on the news. Accidents do happen.

Boy, 8, killed in Massachusetts gun show accident
By Associated Press

POSTED: 09:44 a.m. EDT, Oct 27, 2008

WESTFIELD, MASS.: An 8-year-old boy died after accidentally shooting himself in the head while firing an Uzi submachine gun under adult supervision at a gun fair.

The boy lost control of the weapon while firing it Sunday at the Machine Gun Shoot and Firearms Expo at the Westfield Sportsman's Club, police Lt. Lawrence Valliere said.

The boy, Christopher Bizilj of Ashford, Conn., was with a certified instructor and ''was shooting the weapon down range when the force of the weapon made it travel up and back toward his head, where he suffered the injury,'' a police statement said.

Christopher died at Baystate Medical Center.

Police said the boy's father was at the gun fair and accompanied his son in the ambulance, but it wasn't clear if he was at the firing range with Christopher at the time of the accident. Police didn't give the father's name.

Although police called it a ''self-inflicted accidental shooting,'' police and the Hampden district attorney's office were investigating, officials said.

''We are going to review all the circumstance regarding what happened, who was involved, what authorities they may or may not have had, who was supervising,'' District Attorney William Bennett said today.

It is legal for children to fire a weapon if they have permission from a parent or legal guardian and are supervised by a properly certified and licensed instructor, Lt. Hipolito Nunez said.

Those conditions were met in this case, he said. He declined to release the supervisor's name.

The club said on its Web site that the event, run in conjunction with C.O.P Firearms and Training, is ''all legal and fun.'' People are allowed to fire weapons at vehicles, pumpkins and other targets, it said.

Officials of the private club and the firearms group could not be reached for comment. There was no response to a message left on a club answering machine. The C.O.P. group's machine clicked off without taking a message.

The sportsman's club was founded in 1949 and describes itself on its Web site as promoting ''the interest of legal sport with rod, gun, and bow and arrow, both directly and through training.''

It has eight firing ranges as well as archery and fishing facilities located on 375 acres in Westfield, about 100 miles west of Boston.

Ok, What I was saying before is that I agree that there are problems.  Education is definitely a necessity.
Maybe even what some may call a little extreme.  Educate kids on the effects of gun violence, not only the victims, but the criminals.  Show them gory videos of the results of gun violence, the psychological effects on the families of both victims and criminals families, and the sentences that are handed down by the courts in regards to violent gun related crimes. We do this with minors when they get tickets and go to traffic school. We show them the results of bad traffic accidents and or the results involving DUI's and also when excessive speeding is concerned. Just like in sex education the parent's should have the right to sign off on whether or not they want their children to view this material.
I understand the problem. I had a friend who was like a brother and he was MURDERED.  He and his room mate were shot in the head at point blank range and then their bodies were taken and dumped like garbage in remote field. They were missing for 21 days. Waiting to find out 21 days was no picnic either.  It happened about ten years ago and I still feel the anger, the sadness and  the pain. He was about 23 years old and had his whole life ahead of him. What a shame. Not to mention his son of 3 at the time will barely remember his dad.

The answer is not taking away the rights of law abiding citizens, because of the actions of criminals. You can ban the guns, confiscate the guns and destroy the guns, but criminals will do what criminals do. They will find another way to obtain them. At minimum we should have the right to defend ourselves.

I feel the same about assault weapons. It is true that they have no other use, but killing. They are not good for hunting for obvious reasons, but some enjoy them at the outdoor shooting range, which is a controlled environment.  I do believe, however that the police, sheriffs, etc., should be outfitted with them as well. They should not be outgunned.
I am talking about the regular police, etc. There should be a budget for this even in hard times as bad things happen. Taking them away/ Banning them only puts them in the hands of three types of individuals.
1) The  Military,  2) The police and  3) The criminals

This is just my opinion, but I know many who share it.

I enjoy fire-arms, I have participated in skeet shoots, been gofer hunting, pheasant, duck, and deer. Used responsibly guns make for good sport.

The problem is that with our 1 parent homes our youth is not being taught "responsibility" and "concequences" and society is out of control. Even in our two parent homes with both parents working there is very little supervision. I would like to see that parents would be held responsbile for the actions of their children. This works in Singapore and they have the lowest crime rate in the world. In many countries society holds this behavior in check as a child is taught not to bring shame on the family. In summary the problem is not gun control but people control.

In Britan guns are strictly controlled, however the murder rate per capita is about the same as the US. They just use knives, and bare hands. This is the usual statistic that is thrown around by the NRA and supporters. What is often overlooked is the statistic of crimes committed where a fire-arm is present but never fired. For instance if I walked up to a casino cage - pointed a gun and said hand over the money, I would likely get the money. I might not make it across the casino floor but the presence of the gun is a real threat. On the flip side had I walked up to that same cage with a club I suspect I would have been laughed at, then shot. Britian doesn't have this same problem and these types of crimes occur with much less frequently.

I agree that criminals will have access to guns as they steal them from law abiding citizens and illegally import them. The problem is that even if we crimialized posession, stopped making them, selling them, and destroyed all that turned them in,  them there are so many out there that the criminals would still get access to them. So this is not the answer and the money and time we spend debating this is a waste. We won't ever be able to roll back and get to that level of gun control. Like emptying the ocean with a teaspoon.

I would advocate that anyone purchasing a gun should be made to take a firearms training course, so that proper use and storage is taught and hopefully some sense of responsibility would be instilled. Unfortunately you can't regulate stupidity.

I am not a big supporter of having a gun in my home as I think its a hazzard waiting to happen (i have young kids) but the NRA did make a point after 911. They suggested that if they gave a loaded hand gun to everyone who got on a plane then at least the good guys would out number the bad guys.

I agree Jay. In California you have to take a small course and pass a test. A safety test. That's a good thing.
Yes, parents should be held responsible. With children proper safety has to take place. One should not only own a gun safe, but trigger locks, etc. all of this in addition to the education.

I agree with Joey 100% we do need to teach all of our kids to respect firearms and learn to use them properly. In the above video I would wager that the first thing that all of those kids learned was there is no such thing as an unloaded weapon, always check, never assume. In each and every case in the Video there was responsible Adult supervision with the kids. the problem of the street violence etc is mostly due to lack of education about firearms and their safe use, as well as not having a "mentor or father or mother" who gives a shit what happens to them. It is not proper to blame the gun for the usage, that is like blaming the cars for drunk driving.

U.S. Leads Richest Nations in Stupidity

ATLANTA -- The United States has by far the highest rate of gun deaths -- murders, suicides and accidents -- among the world's 36 richest nations, a government study found.
The U.S. rate for gun deaths in 1994 was 14.24 per 100,000 people. Japan had the lowest rate, at .05 per 100,000.
The study, done by the Centers for Disease Control and Prevention, is the first comprehensive international look at gun-related deaths. It was published Thursday in the International Journal of Epidemiology.
The CDC would not speculate why the death rates varied, but other researchers said easy access to guns and society's acceptance of violence are part of the problem in the United States.
``If you have a country saturated with guns -- available to people when they are intoxicated, angry or depressed -- it's not unusual guns will be used more often,'' said Rebecca Peters, a Johns Hopkins University fellow specializing in gun violence. ``This has to be treated as a public health emergency.''
The National Rifle Association called the study shoddy because it failed to examine all causes of violent deaths.
``What this shows is the CDC is after guns. They aren't concerned with violence. It's pretending that no homicide exists unless it's related to guns,'' said Paul Blackman, a research coordinator for the NRA in Fairfax, Va.
The 36 countries chosen were listed as the richest in the World Bank's 1994 World Development Report, with the highest GNP per capita income.
The study used 1994 statistics supplied by the 36 countries. Of the 88,649 gun deaths reported by all the countries, the United States accounted for 45 percent, said Etienne Krug, a CDC researcher and co-author of the article.
Japan, where very few people own guns, averages 124 gun-related attacks a year, and less than 1 percent end in death. Police often raid the homes of those suspected of having weapons.
The study found that gun-related deaths were five to six times higher in the Americas than in Europe or Australia and New Zealand and 95 times higher than in Asia.
    Here are gun-related deaths per 100,000 people in the world's 36 richest countries in 1994: United States 14.24; Brazil 12.95; Mexico 12.69; Estonia 12.26; Argentina 8.93; Northern Ireland 6.63; Finland 6.46; Switzerland 5.31; France 5.15; Canada 4.31; Norway 3.82; Austria 3.70; Portugal 3.20; Israel 2.91; Belgium 2.90; Australia 2.65; Slovenia 2.60; Italy 2.44; New Zealand 2.38; Denmark 2.09; Sweden 1.92; Kuwait 1.84; Greece 1.29; Germany 1.24; Hungary 1.11; Republic of Ireland 0.97; Spain 0.78; Netherlands 0.70; Scotland 0.54; England and Wales 0.41; Taiwan 0.37; Singapore 0.21; Mauritius 0.19; Hong Kong 0.14; South Korea 0.12; Japan 0.05.

USA you have something to be proud of..................

So Ozzy, if the solution to violent crime is to eliminate guns, why are lawmakers in the UK looking to eliminate long pointed kitchen knives from society as a way to reduce violent crime? Also, if guns are the problem, why doesn't Switzerland have the same problem? Guns are more prevalent there than here.

Could it be that there are violent people in society that will use whatever weapon happens to be present? Could it be that a better approach to reducing violent crime would be to reduce or eliminate the factors that lead members of society to participate in violent behavior?

Have you ever looked at how well the "War on Drugs" is working? Making guns illegal in the US will not eliminate the presence of guns in the hands of criminals, any more than making drugs illegal in the US eliminated their presence in the hands of drug addicts.

As far as your study goes, was the suicide rate in Japan higher or lower than in the US?

Firearms Industry Addresses Rising Gun Sales; Obama Administration Showing Anti-Gun Cards Early

Last update: 5:29 p.m. EST Nov. 10, 2008

NEWTOWN, Conn., Nov 10, 2008 /PRNewswire-USNewswire via COMTEX/ -- As firearm sales continue to increase this year, at a rate of 10 percent over the same period last year and 15 percent in October alone, the National Shooting Sports Foundation (NSSF) -- the trade association for the firearms industry -- is pointing to gun-owner concerns about an Obama Administration as reason for the boom.

Last week President-elect Obama's Web site had posted his administration's agenda for curtailing the Second Amendment rights of law abiding Americans, thereby validating the concerns of gun owners, sportsmen and firearms enthusiasts all across the country. Curiously, the Obama-Biden gun control agenda was taken down from the Web site after just two days.

President-elect Obama's Web site stated he would make permanent the expired "assault weapons" ban of 1994,

A ban on firearms that was based on cosmetic appearance, such as the type of stock on the gun, and not functionality. The expired ban did nothing to reduce crime while it was in place. President-elect Obama's Web site intentionally misled the American people by referring to these firearms as "weapons that belong on foreign battlefields." These firearms are not machine guns. In reality, these commonplace firearms that President-elect Obama wants to permanently ban are used in shooting competitions and are found in homes and hunting lodges all across the country. They fire only once with each trigger pull, no spray firing, and they shoot the same ammunition as other firearms of the same caliber.

President-elect Obama has also promised to repeal the Tiahrt Amendment, a law which restricts public access to sensitive, law enforcement -- only firearms tracing data. Public release of gun trace data outside law enforcement has and will continue to jeopardize ongoing criminal investigations, putting the lives of law enforcement, witnesses and others at risk. This is why Congress, ATF, and law enforcement, including the nation's largest police organization, the Fraternal Order of Police, agree on the importance of securing this sensitive data.

Access to gun trace data should only be available to law enforcement taking part in a bona-fide investigation, and law enforcement already has the access it needs for this purpose. No law enforcement agency has ever been denied access to trace data as part of a criminal investigation.

The Obama-Biden Web site also called for "childproofing" all firearms, despite firearm-related accidents being at their lowest levels in history, including a 60 percent decrease over the last 20 years, and a federal law that requires firearms dealers to provide a lock with each handgun sold and to have locks available for consumers to purchase. Firearms industry members have a long history of supporting the safe and responsible use and storage of firearms through programs such as Project ChildSafe, a campaign developed by the NSSF that has distributed over 35 million free gun lock safe storage kits throughout the United States. For years, manufacturers have voluntarily provided a free locking device with each new firearm. Thankfully, the National Safety Council reports that childhood firearms accidents now comprise less than 1 percent of all fatal childhood injuries.

Finally, the appointment of Rahm Emanuel, the strident chief architect of the Clinton-Gore gun control agenda, as President-elect Obama's chief of staff sends an unambiguous message to gun-owners and members of the firearms industry.
"The increase in firearms sales was predictable," said NSSF Senior Vice President and General Counsel Lawrence G. Keane. "It's clear from President-elect Obama's voting record, and the promises that he continues to make, that gun control will be coming back to the White House. Eloquent rhetoric notwithstanding, sportsmen, gun owners and prospective gun owners recognize this and are reacting accordingly."
For more information on gun sale statistics, legislative issues and general firearm related questions, please visit the NSSF Web site at www.nssf.org -- the media's resource for all things firearms.

Serves him right. The problem with increased regulation is it only makes it tougher on the HONEST person.
The bad people/criminals will ALWAYS be able to get their weapons on the black market. It's too bad laws
are as tough as they are. If criminals knew every other person was carrying their own weapon, they might
just think twice about committing the crime! Just like in this case, this guy was prepared. Police aren't and
cannot be everywhere. WE should be able to defend ourselves to whatever end! IMO

By Bob Unruh
© 2009 WorldNetDaily

The state of Montana has drawn a line in the sand, challenging the federal government to decide whether to follow the U.S. Constitution with a new gun law that exempts from federal regulations any gun, gun accessory or ammunition made in the state and intended for use there.

"What this boils down to is:

    * "Guns and ammo made, sold and used in Montana do not require any federal forms.

    * "Silencers made in Montana and sold in Montana would be fully legal and not registered.

    * "There would be no firearm registration, serial numbers, criminal records check, waiting periods or paperwork required.

Moving to Montana soon," wrote a blogger called Primevalpapa.

In an era in which the administration of President Barack Obama is replete with anti-gun activists in influential positions, including an attorney general who supported a complete handgun ban in the District of Columbia before it was tossed by the U.S. Supreme Court, Montana's move is being called nothing less that revolutionary.

The legislative plan, signed recently by Gov. Brian Scheitzer, a Democrat, is called, "An Act exempting from federal regulation under the Commerce Clause of the Constitution of the United States a firearm, a firearm accessory, or ammunition manufactured and retained in Montana."

The plan cites the 10th Amendment to the U.S. Constitution that "guarantees to the states and their people all powers not granted to the federal government elsewhere in the Constitution and reserves to the state and people of Montana certain powers as they were understood at the time that Montana was admitted to statehood in 1889.

"The guaranty of those powers is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889," the legislation states.

"The regulation of intrastate commerce is vested in the states under the 9th and 10th amendments to the United States Constitution, particularly if not expressly pre-empted by federal law. Congress has not expressly pre-empted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition," it says.

Further, state lawmakers cited the Second Amendment right of the people to "keep and bear arms as that right was understood at the time that Montana was admitted to statehood in 1889."

It specifics that "unshaped wood" and other components are not considered firearms and sets out simple requirements:

"A firearm manufactured or sold in Montana under [sections 1 through 6] must have the words 'Made in Montana' clearly stamped on a central metallic part, such as the receiver or frame."

At the FreedomsPhoenix blog, where author Ernest Hancock had a checkbox for visitors asking whether they wanted to be a "gun owner" or a "victim," he described the Montana action as simple defiance of the federal government.

"This will prompt a showdown between the federal government and the state of Montana. The federal government fears citizens owning guns. They try to curtail what types of guns they can own. The gun control laws all have one common goal – confiscation of privately owned firearms," he wrote. "Montana has gone beyond drawing a line in the sand. They have challenged the federal government."

He cited "important points" about the plan:

"If guns and ammunition are manufactured inside the state of Montana for sale and use inside that state then the federal firearms laws have no applicability since the federal government only has the power to control commerce across state lines. Montana has the law on [its] side," he said.

"Silencers made in Montana and sold in Montana would be fully legal and not registered. … There would be no firearm registration, serial numbers, criminal records check, waiting periods or paperwork required. So in a short period of time there would be millions and millions of unregistered untraceable guns in Montana. Way to go Montana," he said.

Ammunition Shortage Affects Gun Owners, Police

Lancaster County Shop Limits Purchase Of Ammo

POSTED: 10:26 am EDT May 28, 2009
UPDATED: 10:46 am EDT May 28, 2009
ELIZABETHTOWN, Pa. -- There are growing concerns over a nationwide ammunition shortage.

It has been an issue for gun owners for some time, but some say it has gotten worse.

Shelves that used to be stocked with popular handgun ammo are all but bare.

At Trop Gun Shop in Elizabethtown, Lancaster County, there is a limit on how many boxes consumers can purchase.

The shortage is affecting law enforcement.

The SERT team of Lancaster County practices twice a month.

The required training has been affected by the shortage and it is a concern for officers.

"Yes, it's a concern because it does affect how you train," said Detective Jim Zahm, who commands the SERT team. "It affects how much ammunition you can fire at any given training exercise."

A scarcity of raw materials used to make brass, bullets and powder is contributing to the shortage.

State police are not affected because they use a 45 gap round, which is not in high demand.

Filling orders is also an issue; what used to take a few weeks can now take up to 18 months.

Suppliers are required to fill military orders first, then police and consumer orders.

Out of ammo

Bullets getting harder to come by for police and citizens alike

By Bridget Lewison/The Daily News

BULLHEAD CITY - In recent months, customers looking to buy ammunition for their handguns and rifles have been met with empty shelves at Walmart, Big 5 and other retailers in the Tri-state.

Reasons given for the shortage vary, but the law of supply and demand also means prices have spiked. The pinch is not only being felt by citizens but by law enforcement.

“There is a major issue within police agencies across the nation,” said Bullhead City Police Department Capt. Ted Appleby. “Right now, we're actually waiting on an order of ammo we put in six months ago. Some agencies are seeing 18-month delays.”

Appleby says the department has enough ammunition on hand and, although higher prices have impacted the agency, it has the support of the City Council on the issue.

“We're not using as much ammo as we used to,” he said. “We're being conservative, but we still are meeting training requirements.”

According to the Newtown, Conn.-based National Shooting Sports Foundation, April marked the sixth consecutive month of significant increases in gun sales. Data released by the FBI's National Instant Criminal Background Check System (NICS) reported 1,225,980 checks in April 2009. This figure is a 30.3 percent increase over April 2008.

In November, a record 1,529,635 background checks were performed, a 42 percent increase over November from the previous year.

“Everything has gone up so much in price,” says Wes Griffin, a gun and ammunition dealer who has lived in Bullhead City for 50 years. “Certain guns that are popular for home defense, such as the .38 automatic, I have one for sale but I have no ammo. I can't get it.”

Griffin says people are “panic buying” out of fear over what the new administration may do in respect to gun laws.

“A lot of people are concerned,” said Arizona District 3 Sen. Ron Gould, of Lake Havasu City. “When Walmart gets a shipment of ammunition, it goes out the door within a couple of hours.”

Gould, a Republican, says gun owners are stockpiling because they're afraid of losing their gun rights.

“People are afraid of what Obama and the Democratic Congress is going to do,” he said. “We've got an (U.S.) attorney general (Eric Holder) that's an anti-gun attorney.”

Gould, who saw gun and ammunition sales step up even before Obama was elected, says the stockpiling has created a bottleneck in ammunition supplies across the country.

“It's feeding on itself,” he said. “Because there's a shortage, that scares people. Then they hoard.”

Ammunition reloading supplies also have become scarce.

“I can't even get primers for reloading, and without that, you can't reload,” said Griffin. “Popular powders also are hard to get. Bullseye, the fastest burning and most economical, you just can't get it.”

Once-fired brass cartridges used in reloading also have become hard to come by, says Gould.

“Vendors used to buy them from the government but now rather than being sold for reloading, they're selling them for scrap metal,” he said. “Fiscally, that's not too bright. (The cartridges) are worth more as once-fired than scrap brass.”

While most retailers have boosted the cost of boxed bullets, Walmart has not followed suit.

“We're keeping it at the same price, but we have seen a shortage of handgun and rifle ammo,” says Chuck Cherry, who works in the Bullhead City retailer's sporting goods department. “Shotgun shells we have plenty of.”

Cherry said he believes manufacturers are one of the hang-ups in the lack of ammunition, citing retail's place in the supply chain.

“Speer (Bullets, out of Lewiston, Idaho) has a big contract through the government,” he said. “The military gets its share, then the police departments, then the Homeland Security Department, and then everyone else.”

What a dear friend told me is that everything happens for a reason.
After thinking about this for a long while I believe he is right.  America has become complacent and we are getting what the people voted in.  I pray too this will be a wake up call and America come out stronger.   Just look what happened after the Carter disaster.

But sadly I agree it will take decades to correct.

While I won't defend all of Obama's actions, I have to say that I have the exact same feelings regarding the terrible damage the GW Bush administration did to this country and its constitution, or have you all forgotten the new level of closed and secret government that he (and his father) advanced, and the passing of the "Patriot Act", a despicable use of Orwellian Doublespeak that played on our fears (as most despots do) to enact a sweeping series of laws that undermined the very core of our Constitution and Bill of Rights, and brought us much closer to a Fascist state of government than I hope to ever see again in my lifetime in this country. The damage is slowly being undone, but each part of the "act" must be challenged separately in the courts. I am grateful to Obama for helping to accelerate the process of dismantling these laws.

Bush also spent our government into oblivion supporting a war that we should have pulled out of years ago. Has everyone forgotten that the war was entered based on the false assumption that Iraq was hiding a stockpile of weapons of mass destruction? Regardless of whether this position was truly borne of ignorance or inaccurate intelligence, or was conjured up as an excuse to get us in there, it is clear to me that once involved, the reason to persist was solely to protect the interests of big oil, in which the Bush family was and is a part of, and whom had GWB in their hip pockets, voluntarily or otherwise.

In addition, there are still those of us who don't consider GW Bush to be a legally elected president. All of the conservatives out there try to downplay and make fun of those of us who recognize that due process of law through the Supreme Court was eclipsed to get him installed as president, despite the evidence that the votes in Florida were manipulated, or was I supposed to just put on my "stupid" hat once he took office and forget what happened?

GW Bush also worked harder than any president in recent history to integrate conservative Protestant and Catholic Christian religious morality and beliefs into government policy (although he is considered to be a Methodist), another spit on the core of our founding father's intent. The separation of church and state was fundamental, as so many in the new world were fleeing religious persecution in coming to the colonies. I do not want my government adopting the moral imperative of any religious organization, Christian or otherwise, and doing so was a slap in the face to those who don't happen to be part of the "majority religion". Our founding fathers got it right the first time.

You are all decrying the emasculation of the second amendment and blasting our current president for his position on that issue. Fair enough. But what about the damage done by the Bushes to the First, Fourth, Fifth, Sixth, Eight, and Fourteenth amendments? Is you American dream really to be able to stockpile semi-automatic assault weapons? Is it to have enough arms to defend yourself against your own government when they become so corrupt that it becomes necessary to do so? Is it to turn a blind eye to those who are not as fortunate as yourself and coldly say that they should be able to succeed without any government aid, as you have, without any empathy for their plight? My American dream would be to live in a country where people who are different from me (or you) can live in peace and respect, where differences are not just tolerated, but celebrated, and without my government imposing a conservative morality of a particular religion on its citizenry.

Gun advocates predict drop in crime if gun ban is lifted

September 30, 2009
BY ABDON M. PALLASCH AND FRAN SPIELMAN Staff Reporters

The U.S. Supreme Court’s decision Wednesday to hear a challenge to Chicago’s strictest-in-the-nation handgun ban means the other holster is ready to drop on the ban, gun advocates said Wednesday.

The high court last year threw out Washington, D.C.’s gun ban in the District of Columbia vs. Heller case, but stopped short of invalidating the rest of the country’s handgun bans because that case dealt only with federal, not local bans.

The fact that the court is taking this case means it is ready to say that the 2nd Amendment Right to Bear Arms can’t be infringed by local governments either, said Alan Gura, who argued Heller before the court and will argue this one too.

Gura flew from Virginia to Chicago Wednesday to appear at a news conference with gun advocates who predict the crime rate will drop in Chicago when handguns are legal again here and would-be burglars opt not to break into homes for fear the owners are armed.

“I'm confident that a year from now there will not be a Chicago handgun ban,” Gura said.

“I want to be able to protect myself in my own home -- this is a right that we have that has been moved away from us and we should have it back,” said Otis McDonald, 76, a retired janitor who says his neighborhood of Morgan Park has gotten rougher in recent years and kids who used to play basketball in his backyard have approached him with guns on the street.

“I I don’t have any intention of going out there and shooting up anybody. The people who want to control me — these are the people I want to protect myself from.”

Mayor Daley is in Copenhagen lobbying to bring the 2016 Olympics here. Ever since last year’s Heller decision, which Daley called a “frightening” decision that “changed the rules” of inner-city policing, city attorneys have expected the fate of Chicago’s 1982 handgun ban to be decided by the U.S. Supreme Court.

“It’s not a blow to us in the sense that it’s a surprise,” said City Law Dept. spokeswoman Jenny Hoyle. “But we are obviously concerned about what a final decision could mean for Chicago.” Hoyle said city attorneys remain “encouraged” by some of the language the Supreme Court used in overturning Washington D.C.’s handgun ban.

“The Heller decision didn’t say there has to be unrestricted access and ownership [of] handguns. They allowed for the possibility that some restrictions might be appropriate,” she said.

As a result, Hoyle said the Chicago decision is “not necessarily gonna to be a ‘yes’ or ‘no.’ There could be nuances to the decision that would impact what we may or may not have to do in the end.”

In December, the D.C. Council replaced its overturned law with new regulations that require gun owners to receive five hours of safety training and register their firearms every three years.

Gun owners would face criminal background checks every six years.

At the time, Daley hinted strongly that he intended to use the city’s home-rule power to mimic the D.C. changes.

But, Hoyle said Wednesday the city would await the Supreme Court ruling before establishing a fall-back position.

“Right now, we’re planning on fighting the battle and defending our ordinance in its current form,” she said.

Asked if Chicago has a “Plan B,” she said, “Assuming the worst case scenario — that they said the 2nd Amendment is applicable to cities and states — it wouldn’t necessarily prohibit us from having some kind of registration or some kind of monitoring of gun ownership or setting up some pre-requisite for it.”

Corporation Counsel Mara Georges was unavailable for comment on the Supreme Court ruling, having accompanied the mayor to Copenhagen for Friday's vote by the International Olympic Committee.

Starting Wednesday, Arizona citizens with a concealed weapons license can bring guns into bars.

It is no nod to the Grand Canyon State’s Wild West beginnings. It is part of a national trend.

Arizona will be the 41st state to let bar patrons pack heat (only if they’re not drinking alcohol, however). Meanwhile, the list of places where gun owners can bring their weapons is growing, as the gun lobby increases pressure on statehouses and Congress to broaden Second Amendment rights.

“The trend over the last 20 years is more freedom in most states for individuals to carry guns,” says Robert Cottrol, a law professor at George Washington University in Washington.

The issue took on even greater importance Wednesday when the US Supreme Court announced it will hear arguments as to whether a Chicago handgun ban violates the Second Amendment right to bear arms. The case could have implications for all local gun restrictions, which have been a central tenet of gun control.

Arizona

Arizona’s “guns in bars” law follows closely on the heels of its so-called “parking lot” law, which took effect Tuesday. It allows licensed gun owners to store guns in locked cars, even if they’re on someone else’s private property.

“Each person has the constitutional right to bear arms in order to defend themselves and their family while going about the normal course of their lives,” wrote Doug Little, the founder of the Armed Personal Defense Institute in Ariz., on his blog.

“The ‘parking lot law’ restores a right to an employee that their employer took away from them by prohibiting them from bringing a firearms with them to work and storing it in their vehicle,” he adds.

Congress

Beyond Arizona, Congress voted earlier this summer to allow concealed weapons in national parks. Last week, the Senate voted to allow guns in the checked baggage of Amtrak trains, despite warnings from the company that it would produce “numerous challenges.”

While guns are allowed in the checked luggage of airplanes, Amtrak has not allowed guns on broad its trains since 9/11.

“Americans should not have their Second Amendment rights restricted for any reason, particularly if they choose to travel on America’s federally subsidized rail line,” said Sen. Roger Wicker (R) of Mississippi in a statement.

Other states

In Arkansas, state Rep. Beverly Pyle proposed allowing guns inside places of worship earlier this year. It seems as though the state’s ban will stand, but the issue is percolating.

Ken Pagano, a pastor in Kentucky, in June sponsored a bring-your-guns-to-church day.

God and guns were part of the foundation of this country,” Mr. Pagano told The New York Times.

Going forward, gun owners hope to make sure that no place will be off-limits.

“My guess is that too that the extent that there are restricted spaces, there will be a movement to push against that,” Professor Cottrol says.

The best thing about the video was the backstop.

Wet phone books don't come anywhere near the consistency of a live body, and using a +P+ for the 9 and a stock low pressure light bullet round for the .40 isn't anywhere near an even test. If you're gonna drive the .40 slow, use a 180gr bullet.  :214-

And, I'll take the .40 any day. The ex preferred the 9 because the recoil was less, which (strangely enough) is the same reason my daughter likes the 9 better.

I have no issue over the second admendment however the difference that Switzerland has over the rest of the world is that each and every one who has a gun has had proper military training and for the most part can be considered responsible with the weapon. If they are not responsible they have the weapon taken away and they go to prison. Also all weapons are registered. In the US any idiot can own a gun and has no self control in whiping it out at the playground showing off or just acting menacing. This is not what the second admendment was meant to permit.

Yep.

However, that is not a gun issue, it's a societal issue. As long as we keep promoting social irresponsibility, we'll keep creating the individuals you speak of.

Our current Liberals: Guns = bad,  criminals = poor misunderstood individuals who should not be held accountable for their actions.

The Conservatives are just as bad with their war on drugs. We'll never control drug usage by trying to control the drug trade.

Supply and demand is a tough nut to crack, whether it's being applied to guns or drugs.

Ariz. Senate passes concealed weapons bill

Associated Press - March 29, 2010 7:44 PM ET

PHOENIX (AP) - The Arizona Senate has approved legislation that would make Arizona the third state allowing people to carry concealed weapons without a permit.

The Senate approved the measure on a 20-10 vote Monday. The House delayed a planned vote.

The legislation would make it legal for any U.S. citizen 21 or older to carry a concealed weapon in Arizona without the permit now required.

Currently, carrying a hidden firearm without a permit is a misdemeanor punishable by up to six months in jail and a fine of up to $2,500.

If the legislation is enacted, Arizona would join Alaska and Vermont in not requiring permits to carry concealed weapons.

Oh and by the way, once some of these bastard criminals start getting killed by the people they are trying to victimize, well, they will stop because they don't want to get killed themselves, look for an easier target. NOT DOCTORED AT ALL. The reason I posted this is cause I was watching History Channel today and saw this guy, Tom Knapp, Bill ???, and another couple guys and
when I saw him shoot that revolver like a mini my friggin jaw hit the floor so friggin hard my wife had to go into the basement and push it back up through the floorboard
with a broomstick! I immediately went to YouTube to find a video to share on here. Holy Hell! That's freaking amazing!

Get this...the guy shoots a 500 Mag and has a custom holster with only like a 1" lip at the base of the barrel so basically the split second he touches the gun, he's firing!
Even the Super Slow-Mo is hard to see cause he's so friggin fast!....its SICK!

Blake - The Barret is my favourite weopon in Delta Force (Old PC Game) - Thats probably the closest I will ever get to one. I does look like a very powerful weopon. Over here in South Africa laws to obtain legal weopons are pretty restrictive - Illegal weopons of course are another matter. My Dad tought me at an early age to handle and respect weopons but its been ages since I have actually handled one.

REBELLION IN AMERICA
State No. 6 tells feds to stuff their gun regs
Arizona declares weapons exempt from national firearms paperwork

By Bob Unruh
© 2010 WorldNetDaily

A sixth state – Arizona – now has declared that guns made and kept inside its borders essentially are free from federal application, registration and ownership regulations in a surging movement among states that one supporter describes as a direct challenge to "a government monopoly on the supply of firearms."

Gov. Jan Brewer this week signed the state's version of a "Firearms Freedom Act," which originated in Montana and now has been adopted by six states, with several dozen more in various stages of their own plans.

Brewer issued a statement that the law is intended to give Washington the message that they should not try to "get between Arizonans and their constitutional rights."

Arizona joins Wyoming, South Dakota, Utah and Tennessee as well as Montana, where Gary Marbut of the Montana Shooting Sports Association was a key proponent.

Marbut has warned that under the current system of federal approval for gun purchases, federal registration requirements, federal restrictions and federal limits, the U.S. essentially has established a monopoly on guns.

All the information you'll ever need about guns, ammo and a special video on how to make them, found in the "Firearms Multimedia Guide."

The "Firearms Freedom Act" measures being adopted around the nation now, he said, are supported by the Ninth and Second Amendments to the U.S. Constitution and are needed to break down that monopoly.

California Democrat proposes mandatory gun registration

A California Democrat is proposing a new law requiring residents to register their shotguns and rifles or go to jail, CBSNews.com has learned.

Assemblyman Mike Feuer, whose district includes Beverly Hill and West Hollywood, this week introduced legislation ordering law enforcement to "permanently keep" records of anyone who buys a gun from a dealer or an individual. California already stores information about handgun purchases.

Feuer is no friend of firearms owners: his previous legislative effort, which Gov. Arnold Schwarzenegger signed into law, required all new handguns to include "microstamping" technology that can imprint serial numbers on spent ammunition casings. As a Los Angeles city councilman, Feuer proposed limiting city residents to one gun a month.

Feuer spokeswoman Arianna Smith declined to answer questions about the bill on Tuesday afternoon, saying the staff member involved was in a meeting and not immediately available.

The proposal comes as the U.S. Supreme Court is considering a landmark civil rights case, McDonald v. Chicago, which will decide whether Second Amendment rights in the federal constitution trump state anti-gun laws. But California is proposing mandatory registration -- and not a flat ban, as Washington, D.C. once tried and the justices rejected -- and even legal scholars specializing in this area disagree about whether registration is constitutional.

"Even though the constitutionality of such a measure is a close call, it is a horrible public policy choice," says Gene Hoffman, chairman of the CalGuns Foundation. "Just as Canada is about to do away with their long gun registry after squandering $1 billion, California wishes to attack law abiding gun owners for firearms not used in crime."

Mexico’s President Calls On Congress To Pass Assault Weapons Ban

 :30- :30- :30- :30- :30-

Quote
Washington (CNN) – Mexican President Felipe Calderon addressed two of America’s most contentious political issues during a speech to the U.S. Congress Thursday, asking for a return of the assault weapons ban and blasting Arizona’s controversial new immigration law as a “terrible” endorsement of racial profiling. …

Calderon pointed out that the challenge to Mexican security has “roots on both sides of the border.” He cited the high rates of consumption of illegal drugs in the United States, and praised the Obama administration for its recent initiative to lower demand.

He also urged Congress to reimpose the assault weapons ban, asserting that violence in Mexico spiked after the ban was lifted in 2004. Mexican authorities in recent years have seized 45,000 weapons that could be traced to the United States, he said, and there are now roughly 7,000 gun shops along the U.S. border with Mexico where assault weapons can be easily acquired.

Saying he respects the U.S. Constitution and understands “the purpose of the Second Amendment,” he added, “believe me – many of these guns are not going to honest American hands.”

“Today these weapons are aimed by the criminals … at Mexican civilians and authorities,” he said. “With all due respect, if you do not regulate the sale of these weapons in the right way,” American authorities and civilians may be soon face a similar challenge.

http://www.youtube.com/watch?v=wgkh_1sgFrs (http://www.youtube.com/watch?v=wgkh_1sgFrs)
 :wtf1- :wtf1- :wtf1- :wtf1- :wtf1- :wtf1-

Calderon glibly suggests that it’s American guns being used in Mexican crimes, but again the statistic which Calderon and Obama use to substantiate this claim is false. What’s true is that 90% of the guns the ATF has tracked from Mexican crime scenes have originated in the United States. But it’s also true that the ATF only checks a small percentage of guns used in Mexican crime. Because a vast majority of the guns have markings indicating that they clearly didn’t come from the United States.

The truth is that something like 8% of the guns used in Mexican crimes originate from licensed gun dealers in the United States. Because it turns out that, shockingly enough, people intent on using guns to commit crimes usually aren’t to respectful of things like gun control laws.

And remember, Calderon’s argument is based on the idea that the mere presence of guns causes crime. Which is a notion that, while popular with gun control types, has no basis in reality. Calderon claims a spike a Mexican crime since America dropped the assault weapons ban in 2004. Yet, despite a huge increase in gun sales since 2004 (and especially since Obama and Democrats rose to power in 2006 and 2008) America has seen no corresponding increase in crime. In fact, the opposite has been true.

As gun sales have gone up, as the number of concealed carry permit holders has gone up, crime has gone down.

There are a lot of causes for crime in Mexico, no doubt. And some of those causes are American policies (I’m looking at you, drug warriors). But guns aren’t the problem with crime in Mexico.

Man on the moon in 1969 ---- hmm there are a lot of conspircy theories who says they didn't.
We have not put anyone that far into space in a long time.

The biggest challenge is the Van Allen belt - Outer space is awash with deadly radiation that emanates from solar flares firing out from the sun. Standard astronauts orbiting earth in near space, like those who recently fixed the Hubble telescope, are protected by the earth's Van Allen belt. But the Moon is to 240,000 miles distant, way outside this safe band. And, during the Apollo flights, astronomical data shows there were no less than 1,485 such flares.

Check this link out......    http://www.apfn.org/apfn/moon.htm

80-Year-Old Chicago Man Kills Armed Home Invader   :3- :3- :3- :3- :3-  :178-

An 80-year-old Chicago man shot and killed an armed man who broke into his two-story house in a pre-dawn home invasion Wednesday on the city's West Side.

At about 5:20 a.m., the homeowner and his wife, also in her 80s, discovered the intruder entering their home through a back door. The homeowner, who had a gun, confronted and killed the burglar on the doorstep, police said. Cops said the intruder also fired his gun during the struggle.

"It's a good thing they had a gun, or they might be dead," said Curtis Thompson, who lives next door to the couple, the Chicago Sun-Times reported.

Neighbors described the elderly couple, who both walk with canes, as pillars of the community in Garfield Park, where home invasions have been all too frequent.

Their neighbor, Shaquite Johnson, told MyFoxChicago that the two are "heroes" for fighting off the attacker — and that the shooting means there is "one less criminal" walking the streets.
"They don't bother no one, so why would anyone do that to them?" she said.

Relatives of the couple told the Sun Times that the man is an Army veteran, his wife a former nurse. Police said neither the man nor the woman was injured in the attack.

The assailant, who was described by police as being in his 30s, was found slumped on the back doorstep of the couple's house, removed four hours after the shooting, the Sun Times reported.

No charges have been filed against the homeowner, but Chicago currently has a statute outlawing the possession of handguns. Its legality is currently being decided by the U.S. Supreme Court.

A high-profile Chicago attorney has already stepped forward offering to represent the man pro bono if he faces charges for possessing a weapon.

"Self-defense isn't just a right, it's a duty," said attorney Joel Brodsky. "If this man is prosecuted for saving his own life it's not just a travesty, it's justice turned inside out."

CA Assembly votes to ban carrying guns openly

ONLY IN THE COMMUNIST COUNTRY OF CALIFORNIA

:wtf1- :18- :189- :56- :209- :214- :106- :210- :178-

People who support the state's open carry gun law are feeling threatened. California's assembly voted to ban gun owners from carrying their guns in public. Right now, its legal, but only if the weapon is unloaded. It is an old right that some believe is a new threat.

The Assembly voted in favor of the bill, which would make it a misdemeanor to carry an unloaded gun in public. Gun opponents also want violators to pay stiff fines as well, but groups like the NRA, hope the bill will die in the Senate.

"This is not a threat to the populous," says Schwartz.

Schwartz is a member of Bay Area Open Carry. He says he carries his gun, for protection. California law allows gun owners to carry their weapons in public, as long as they're not loaded. Assembly Bill 1934 is trying to change that; members voted to make it illegal to carry a gun in public.

"Bringing a gun into the public, makes the public less safe, we don't know the backgrounds of the people carrying the guns," says Karen Arntzen from the Brady Campaign.

The Brady Campaign to prevent gun violence backs the bill. They're sure, instances like these, where open carry members met in places like Starbucks in Livermore and Buck Horn Grill in Walnut Creek gave the bill's authors ammunition and got public sentiment on their side.

"What's the point of having a gun on your hip, if you're not going to do something with it? I don't believe a person wears a gun on their hip like a piece of jewelry," says Leonard Hurwitt from San Mateo.

People have reported seeing guns in public. ABC7's cameras were rolling when Livermore police responded to a call that a man with a gun was standing outside a cafe. It was an open carry member ABC7 was interviewing.

"It would scare me to see somebody wearing a gun from their waist," says Joan Berger from Hillsborough.

"Some people have a knee-jerk reaction to this method of open carry and I empathize with those people, however, they need to understand that their perceived fear does not trump everyone else's rights," says Schwartz.

The bill heads to the Senate next week and both sides are already calling state senators to get their support. The bill would also need the governor's signature before it can become a law.   :30- :25- :30- :25- :30-

Umm, exactly WHY would you open carry in public if it is widely known the weapon is unloaded?  :103-  I mean you've already put yourself at a disadvantage by letting the bad guy know you have the weapon and it will have to be loaded before being fully functional. I, for the life of me, just don't understand the reasoning.

Open carry in Calif.... magazine has to be out of the pistol, but is nearby.... like next to the pistol. It wasnt about ego with the guys I knew doing it, it was about being legal AND having an option if needed. Personally, I almost always carry... loaded and chambered... but its leagal here. In Calif, 99% dont and are ripe for the picking from the bad guys. Those few doing the open carry thing at least have an option to protect themselves.

You'd be surprised at just who is carrying openly in CA... Not a bunch of rednecks, we're talking CxOs and Sr VPs of some of the biggest companies on the planet.

Rick, I understand your response and the ability of having an option. Maybe our bad guys here are smarter than the ones in Cali. They would just adjust their tactics so you wouldn't have the time to load. The risk factor for them is much lower knowing you have to load and possibly chamber before that weapon becomes usable, the risks totheem increase dramatically when the already loaded gun only has to be drawn.

yep.. dont get me wrong, open carry unloaded is goofy, but is better than nothing. One on one, I aint sure how it might work well... but in a situation where you are in a restraunt and someone starts shooting randomly, you have a chance. Look at Luby's in Texas, or the MacDonalds in SD.... either one may have been stopped if someone was open carrying.

The rally in Phoenix was great... about 200 bikes gathered and rolled in together as the crowd at the rally came to the streets and cheered us on.

There were thousands at the actual rally, no idea yet how many total. Speakers were great, to include Sheriff Joe. There was also a group of Mexicans there that used to be a part of La Raza... they warned us that this all has little to do with anything more than a take over of the southwest. They now support SB 1070.

I put all the pics I took up on my facebook... do a search on Facebook for rick@animal-pen.net to find me or go here:

When this came about in DC, they made the fees and red tape huge, limiting people that way. I think this may happen in Chicago now.... we will see. I am just glad we dont have these bullshit laws here in AZ, and no registration :)

Oh ya.. July 29th is when the new law kicks in letting all of us carrying open to carry concealed legally.

Title: Re: Second Amendment News and Views.
Post by: tacman on June 29, 2010, 12:19:09 AM
Actually in the wording of Heller, DC case the Supremes stated that there can't be a"ban" on firearms and the right cannot be abridged with fees and restrictions that would alienate a class of people from exercising their constitutional right. So, high registration fees or the idea Chicago's mayor is floating, requiring liability insurance, would restrict some citizens financially from owning firearms. Unfortunately, this may be another fight in 3-4 years and seeing the lines in which this decision was made, I am less than optimistic. This ruling should have been unanimous, but obviously 4 justices feel some of the Bill of Rights does not apply to citizens. Scary Times!

Oh ya.. July 29th is when the new law kicks in letting all of us carrying open to carry concealed legally.

Why don't I just finish off the day by seeing how many members I can piss off !! I know two for sure, sorry Joey
How in the world can you think a whole State of folks carrying concealed weapons is a good thing? Don't forget that little Gang Bangger down the street can also carry concealed. If the State of Az. is going to let it's citizens carry firearms, why conceal them? I think another word you could use for conceal, is sneaky !! Now I ask you, who likes a sneaky person, it's clear I don't, If your going to do something be up front and out in the open with it.
Yes I own some firearms, I think I should be able to carry them from my gun safe to my Pick Up Truck, and from my truck to a firing range, or hunting area. Other than that they stay home.
I do believe there is three classes of people that should be allowed to carry, Law enforcement, military, and high profile people with a permit. ( I would hate to see a young GI going into town on liberty carring a AR 15 ) stop to think about it I guess in AZ that would be all legal for him to do that!! What a scary thought!!

I would put up a Soap Box smiley, but half the time when I hit a button  for a smiley everything go away. Not going to take a chance this time.

The gangbanger down the street already carries concealed. This law does not affect his actions in the least. This law only applies to law-abiding citizens, because they are the ones who follow the law.

We do carry open in AZ, anyone that wants to and passes the govt red tape to, ie legal to own a gun. If you dont want to, then you shouldnt and shouldnt be forced to. I carry almost daily when I am out running around, on the bike or in the truck. I doubt I scare anyone, other than some fool that may have eyeballed me for a crime. As for the concealed part of our right, currently the criminals are carrying concealed and no one is stopping them... this may even the field a bit. Also, come cooler weather where we have to put our jackets on, we become illegal when my pistol is concealed under the jacket. Might seem minor to a person not carrying, but that makes me a felon instantly. Now that problem goes away.

I would like you to give me some numbers.... the number of legal gun holders that randomly shoot people, or the number of us that have been involved in a home invasion, or maybe the number of us legal folks that have pulled off an armed robbery or carjacking. I sure aint hearing of them.

To make you feel even worse about us, we passed a law where you can carry in a bar now, or restraunt that serves booze.... as long as you arent drinking. That scared lots of folks and they foresaw gunfights in bars like the old west. Hasnt happened.... not one.

Now, as for the permit.... I do beleive in them as far as the training goes for use of a gun, and the laws involved with gun use in your State and federally. Otherwise, a permit is just "permission" to do what the 2nd admendment says you may do as a right. And the constitution doesnt meantion "open carry" or "concealed". Responsible people will do it right, and I prefer to assume more are responsible than not.

I have always wanted people to post signs on thier homes whether they have guns inside or not... here it is assumed you do more often than not.

Post by: rickh on June 29, 2010, 01:12:53 PM
I also have a Smith + Wesson .40 cal semiauto.... longer barrel than yours but lethal just the same. I also have a .380 pocket pistol, is great for on the bike. At the rally on June 5th in Phoenix, the vast majority had either 38 or 40 cal pistols on the hip.

While working in California, I found out while reading the gun laws that my clips for this pistol (bought in AZ) were illegal. They held 14 rounds each, and Calif only allows 10 rounds. So, on the off chance I was questioned, I went ahead and bought the 10 round or "California clips"..... $50 each!! What a racket these laws are. So now, I have 4 clips holding 14 each and 2 clips holding 10 each. If I miss with all those rounds, I shouldnt own this nice pistol.

I have no issue with the second admendment except that there are too many kids, and immature idiots with guns. People who have never had the opportunity to fire a gun safely are just itching to pull that trigger like a big toy. What has changed from the 1800's is that every kid went hunting with their fathers bringing home dinner or some vermon to make a hat. In todays world there is no opportunity to teach such life skills  Ideally I would like to see constripted military service where the proper respect for a gun is taught, so when you are released from service you have the disipline and respect for your sidearm. Switzerland does this and it works. They might even understand the cost of Freedom.

This is not directed towards anyone in particular, it’s just a rant. After all, this is the rants and raves section. :127-

If you could possibly imagine living in a United States a bit smaller than the size of New Jersey (8,000 sq.mi.), and on the shore as NJ is, surrounded by your enemies, who occupy most of the rest of the continental U.S. AND Canada (6,145,000 sq.mi. or 12/3 times the size of the current U.S.), who have sworn your destruction, it might help to put things into perspective.

If you could imagine living with terrorism as a way of life, not just one giant occurrence that happened almost nine years ago that you keep referring back to, but regular weekly occurrences that have gone on for decades, then that might help you put things into perspective.

If you can imagine being resolute enough to ignore the constant threat of terrorism and go proudly about your life, never fearing to go someplace public because of the very real threat of a bomb, and not having your fears fed by a hysterical news media that "blows" everything out of proportion and beats every story to death, then you might be able to put things into perspective.

Oh, and every time your giant neighbor enemies declare war on your little country and you kick their butt, the world demands that you return the land that you won in the war that you didn't start back to your enemies. AND if that's not enough, the local inhabitants of your own country who are of your enemy's descent demand that you give up more of the precious little land you've got so that they can form yet ANOTHER nation of your enemies within your midst -- and the world agrees with them and is pressuring you to do so! Can anyone born and raised in the U.S. relate to that?

Imagine having to give up a quarter or more of your "New Jersey" to your surrounding enemy’s "Russia" (6,145,000 sq. mi. is about 93% the size of Russia) because the world feels sorry for the displaced aliens in your country and feels that they have a right to some of your "New Jersey" instead having the "Russians" give them a piece of one of their giant countries.

Of course, you've got a couple of things going for you. Your enemies are divided amongst themselves, and some of them even declare war on one another. You have the support of a very powerful nation – coincidentally about the size of the U.S. :5- – who helps to keep you well armed. You are typically much more industrious than your enemies and have pioneered ways of making a garden out of a desert using very little water and resources. You are a free nation on the cutting edge of technology, and you don’t repress your women – you arm them! Your nation’s people have been kicked around by the rest of the world for more than two-thousand years and have survived – so you’re a scrappy bunch! Your country, as tiny as it is, is the first place you’ve had in more than two-thousand years to call your own, and you’ll fight for it with everything you’ve got.

That's a small perspective on Israel.

<EDIT> Here's a map that helps to put it in perspective. Get out your magnifying glass to see Israel. Step back from your screen to see the Arab countries.

I must say Stat, that was very well put into perspective.  I like the map as a simple and quick look at the realities of the "intrusion" by Israel.  You do well on that soap box.   :89-  I only hope that ally of theirs that is the size of the U.S. continues to support them, and would even stop pushing them to concede and stop acting as if they know better than they on how to survive.  Good rant!!  I like it!!!   :244-

What you've stated Stat is pretty much right on the money.
I'm pretty much geographically literate so I understand why you put up the map of the surrounding area.
Out here on the east coast, many people in Manhattan, NY have never traveled
further than the edge of Connecticut their entire lives.
They basically get around via subways, taxi's and trains.
It's funny watching the Jay Leno show ( Shows taped out in Cali.) when they interview people
on the street and ask them what the capital of New York is and they answer "Brooklyn"... :5-

On another note, I suspect those Israeli military women paint bullet tips rather than their nails ... :96-

On a more serious note, the last time I visited Israel was in August 2001 to attend a family wedding, right before 9/11 -- I almost didn't make it home. (Remember that all of the air traffic in the U.S. was stopped after the attack.)

While there, I wanted to visit the old city of Jerusalem since I had not seen it in many years. Not one of our group of visiting family members (from the U.S., England, and Canada) would go because they were scared of the terrorist attacks. My Israeli aunt and I traveled there by public bus and spent the day playing tourist. Sure enough, a bomb went off about a block from where we were having lunch. We did not panic, but simply got up and headed off in the opposite direction of the explosion - with my pita and shawarma in tow.  :200- (Hey, why waste a perfectly good shawarma sandwich?  :5- :30-)

:214-  Terrorist tip # 473½:  When an event occurs, DON'T go to see what happened.

Later on we learned that the explosion had been a small car bomb detonated solely for the purpose of luring a crowd to the location, where a second larger bomb was set to explode 15 or 20 minutes later with the intent of killing everyone in the crowd who had gathered. Fortunately the larger bomb failed to detonate and no one was seriously injured.

Was I sorry that I went? Heck no! I had a great day, was the only visiting western family member who got to see the old city again, and I got to spend some quality time with my aunt. Was I rattled? Nope. Maybe I would have been had I been only a hundred meters away, but as it was, not in the least.

For most modern bullet tips, I've seen the following color codes:
Black = Armor Piercing (AP)
Black Tip/Red Band = Armor Piercing Incendiary (API)
Magenta Tip/Red Band = Armor Piercing Incendiary Tracer (APIT)
Sea-Green = Raufoss/High Explosive Incendiary (HEI)
Red/Orange Tip = Red Tracer or Incendiary
Green Tip = Green Tracer

Top Ten Reasons Why Men Prefer Guns Over Women

And here we go...    :5- :5- :5- :5- :5- :5-

#10 - You can trade an old 44 for a new 22.

#9 - You can keep one gun at home and have another for when you're on the road.

#8 - If you admire a friend's gun and tell him so, he will probably let you try it out a few times.

#7 - Your primary gun doesn't mind if you keep another gun for a backup.

#6 - Your gun will stay with you even if you run out of ammo.

#5 - A gun doesn't take up a lot of closet space.

#4 - Guns function normally every day of the month.

#3 - A gun doesn't ask , "Do these new grips make me look fat?"

#2 - A gun doesn't mind if you go to sleep after you use it.

And the Number One reason
Why Men Prefer Guns over women.....

#1 - You can buy a silencer for a gun!

Bill Introduced in South Dakota Would Require All Citizens to Buy a Gun
Posted by Brian Montopoli 128 comments

(Credit: AP)
A group of South Dakota lawmakers have introduced a bill mandating that every citizen in their state over the age of 21 purchase a firearm, the Sioux Falls Argus Leader reports.

Under the bill, the firearm would reportedly have to be "sufficient to provide for their ordinary self-defense" and residents would have six months to buy one after the law takes effect. The only people exempted would be those legally prohibited from owning a firearm.

If this sounds too crazy to be true, it is - sort of. The lawmakers told the Argus Leader they know the bill won't pass and introduced it only to make a point related to the individual mandate in last year's sweeping health care reform law. The mandate, which goes into effect in 2014, requires that all Americans purchase health insurance or pay a fine.

"Do I or the other cosponsors believe that the State of South Dakota can require citizens to buy firearms? Of course not," Republican Rep. Hal Wick told the Argus Leader. "But at the same time, we do not believe the federal government can order every citizen to buy health insurance."

The individual mandate has been at the center of court challenges to the health care reform law. Two federal judges have thus far ruled the law constitutional and two have ruled it (at least in part) unconstitutional. The matter is expected to eventually come before the Supreme Court.

In an appearance on CBSNews.com's "Washington Unplugged" in December, Virginia Attorney General Ken Cuccinelli compared the individual mandate to forcing people to buy guns.

"Never before in our history has the federal government ordered Americans to buy a product under the guise of regulating commerce," he said. "Imagine if this bill were that in order to protect our communities and homeland security, every American had to buy a gun. Can you image the reaction across the country to that?"

Title: Death at my local range today
Post by: poppo on October 25, 2011, 10:24:38 PM
Figured this would be as good as anywhere to post.

There was a death at my local gun range today. Even though I normally shoot on my own land, I often go to this range when hanging out with some of my friends or making a trip to town since it is on the way.  I 'was' planning on going this week.

On the plus side it's a pretty lax range, so you don't have ROs barking orders constantly. On the negative side, there are a lot of idiots that should not even own a gun, and the lack of 'supervision' does not help. I've packed up and left several times because some of some of these idiots.

Anyway, details are still sketchy. Single shot to the head. Not sure if it was a suicide,  accident or foul play.

They do have video surveillance, so they will know one way or another.

I've heard about a couple of gun ranges near Orlando, Florida (due to a radio show out of Orlando that I listen to) where there have been suicides.  Pay a few $$, get a gun, game over.  :(

Sad for the people involved -- both the shooter, and the people who have to clean up after him.

They still have not released the name. I know quite a few people that shoot there.  I hope it was not someone I know. I have a feeling this was not a suicide. All too often I have seen people pointing guns every where except down range.

Another thing that pisses me off is when someone calls a cease fire and they don't check to make sure everyone heard them (there is no PA so you have to just shout and hope everyone can hear you) and they just proceed down range while people are still shooting.  :60-

Once when I was taking my CHL renewal (same range, different area) they tell you no loaded mags past the last firing line. Well this one young guy starts walking up and the RO tells him to unload his mags. Now there are people down range setting up their targets and all of a sudden we hear bang, bang, bang, and everyone is hitting the dirt. The dumb ass though that 'unload your mags' meant to just start shooting to unload them.  :182- Needless to say, they booted him out.

BEXAR COUNTY -- A 29-year-old is dead after suffering a single gunshot wound to the head at the Bullet Hole Shooting Range, 2715 Grosenbacher Road.

Bexar County deputies confirmed the man died following the shooting after 2 p.m. Tuesday.

It has been confirmed that victim was on the shooting range, firing a handgun when he suffered a single gunshot wound to the head. He died at the scene.

Deputies identified the victim as a 29-year-old San Antonio man. His name was not immediately released pending notification of next of kin.

Early investigation indicates it may not have been an accident.

After bystanders at the range noticed the victim had fallen to the ground, they were directed to put their weapons down and leave the range so that detectives could begin their investigation.

Those present during the shooting were wearing headphones and protective goggles, making it very difficult for them to hear or see things around them.

Fortunately, surveillance video may help investigators put the pieces together. Detectives are reviewing the footage now to determine if the gunshot was self-inflicted or if foul play was involved.

Yes, they meant hearing protection. And the 'goggles' better not be imparing your view. At least none of the ones I've ever used do. However, it is a range, so one would expect to be hearing gunshots and nobody is going to be looking every time they hear a shot.

I find it interesting that they still have not determined what happened. They recently renovated the handgun area because they built a school not too far away (same direction that you shoot). This is an outdoor range and so they installed some covering to prevent rounds from going over the berm. But they are using some metal I beams as supports. On some of the gun forums I frequent, I have heard of some freak ricochets happening (rounds coming directly back at the shooter). So I suppose it's possible that a round from the guy's gun or someone else's hit one of those beams and came back.

They did release a name and it was not anyone I know.

It was ruled a suicide.  Unless someone rents a gun, I dont see why they would need to do it at the range.  :60-

Quote
The death of a 29-year-old man found shot in the head at a shooting range has been ruled a suicide, authorities said on Wednesday.

After reviewing surveillance footage, investigators said Jared King, of San Antonio, shot himself with a semi automatic handgun at the Bullet Hole Shooting Range, 2715 Grosenbacher Road.

The Bexar County Medical Examiner said King died at the shooting range just after 2 p.m. Tuesday.

Investigators said King held the gun in his left hand although he was right handed so that nobody would be able to see the gun from where he was positioned. Other shooters at the range were directed to put down their weapons after King was discovered shot.

The shooting range reopened for business Wednesday

I recently acquired one of these. This is a Pietta replica 1861 Remington Army Police, 36 caliber. It's a lot of fun to shoot, though it takes five minutes to load it, so you better finish what you start in six shots. Interestingly, under Federal law it isn't considered to be a firearm.

You can still hear gunshots and even people talking while wearing ear protection, and you can see just fine when wearing eye protection. There's not much point trying to shoot a target if you can't see it, right?  :52- :52- :52- :97- :97-

gun-deals.com is good too for guns and ammo. Google used to be good with it's "clean" interface. But even non-shopping results have beciome more skewed by other junk. Half the time, the top 10 search results are links to crap like ask.com or take you to sites that have nothing to do with what you were searching for.

A LITTLE GUN HISTORY

In 1929, the Soviet Union established gun control.
From 1929 to 1953, about 20 million dissidents,
unable to defend themselves, were rounded up
and exterminated.

In 1911, Turkey established gun control.
From 1915 to 1917, 1.5 million Armenians,
unable to defend themselves, were rounded
up and exterminated.

Germany established gun control in 1938 and
from 1939 to 1945, a total of 13 million Jews and
others who were unable to defend themselves were
rounded up and exterminated.

China established gun control in 1935.
From 1948 to 1952, 20 million political dissidents,
unable to defend themselves, were rounded up
and exterminated.

Guatemala established gun control in 1964.
From 1964 to 1981, 100,000 Mayan Indians,
unable to defend themselves, were rounded
up and exterminated.

Uganda established gun control in 1970.
From 1971 to 1979, 300,000 Christians,
unable to defend themselves, were rounded
up and exterminated.

Cambodia established gun control in 1956.
From 1975 to 1977, one million educated people,
unable to defend themselves, were rounded up
and exterminated.

Defenseless people rounded up and exterminated
in the 20th Century because of gun control: 56 million.

You won't see this data on the US evening news,
or hear politicians disseminating this information.

Guns in the hands of honest citizens save lives
and property and, yes, gun-control laws adversely
affect only the law-abiding citizens.

Take note my fellow Americans, before it's too late!

The next time someone talks in favor of gun control,
please remind them of this history lesson.

With guns, we are 'citizens'. Without them, we are 'subjects'.

I just typed "9mm ammo" into Google's shopping tab and got 2230 results. I guess they haven't implemented it here yet.

The first couple of (default sorted) results are from Cabela's and then one from Adorama Camera, of all places. :25-  ..Then ableammo.com and so forth.

When I click on the link I get a white (blank) page. The link is valid, as it also comes up in a support.google search for "ammunition," but it doesn't work from there, either.

<EDIT> Oh, nevermind, it's a Firefox thing. The page comes up in Internet Exploder.

You might be right, although they haven't said anything to that effect.
"Mossberg 500" came back "banned" with a "no results" response, so the ban is in place here.

What can I say? I foretold the government's shutting down the freedom of the internet back in the late 1990's, stating that the only reason they hadn't done it was that they couldn't figure out how. Sadly, my predictions have been coming true these last few years and now businesses are jumping on the "ban" wagon (pun sadly intended) to help.

I'm not generally pro-gun, but how is this any different from some local religious group telling a school which books should be banned from its library? If guns and ammo are legal in the buyer's state, a search engine as global as Google has no business restricting commerce on the basis of the moral beliefs their senior management.

But then, no one here was naive enough to think that we really live in a free society, were they?  :60-

We are talking about shopping searches, not regular searches.

Do a normal google for Glock 9mm than click on the shopping button on the left or the shopping tab at the top.

Because the 11 results from the  search doesn't give you the shopping results for ammo, or even the best prices. For those results, you have to go to Bing.

Because the shopping option lets you sort by price and/or location and it only has shopping results. The regular search returns anything with the search term in it.

I wish the media would quit referring to Modern Sporting Rifles as Assault Weapons or Rifles
Assault Weapon or Rifle means is Full Automatic Fire AKA machine gun

Semi Auto rifles are not assault weapons but are Modern Sporting Rifles.
AR-15 is not an Assault rifle but a M-16 is an Assault Rifle.

Also leave the High Capacity Magazines alone as well

Most of you anti-gun folks don't even know what a semi-automatic gun is.  And those that think banning guns will somehow keep them out of the hands of criminals are either delusional or just plain ignorant. Mostly the latter.

If you think guns are so bad, why don't you post a "Gun free house" sign on your doors and front lawn and let us know how that works out for you. We see how well the gun free zones worked out at Columbine, Aurora, and Newton.

My prayers also go out to all of the victims that might still be alive if the law abiding citizens would have been allowed to carry in those GFZs.

Merry Christmas to you too.

I am Canadian. We have gun control.
While my heart goes out to the family and lived ones lost I don't believe there is a "technical" solution to the mass shootings that can be fixed by a policy or law. Subsequently I don't take sides on the gun debate.

Ban all guns .... Never get that past the constutionalusts. Even if you could there are too many guns in circulation already. Then there is Mexico - the us has not been able to stem the flow of drugs good luck on guns.

Ban full automatics. - a willed person simply orders the conversion parts online - bits of metal are not illegal.
This is like selling a slot machine permanently altered to take non-currency. 5 min work to reverse this.

Ban semi automatics - this slows the crazys down but I used to be able to get 10 shots off in 30 seconds using a bolt action 22 hunting gophers.

Robin Hood was just as deadly using arrows.

A crazy person with the intent to do harm is going to do this regardless.
If you analyze the shootings not one of these occurred without significant premeditation.

I can buy diesel and fertilizer a lot easier than guns and ammo.
Timothy Mcvay filled up a truck with the above and took out a government building from the street.
I can pull up a lot closer to any school or mall than he ever did.

My point is we need to do a better job of managing the nut jobs of this world and not go after the tools as the crazies will adapt.

Switzerland has a fully automatic in every home. I dont believe i have ever heard of mass shootings. The difference is that all males from 16 - 50 spend 6 weeks a year in the army. They do a lot of physogical testing and any one with an off profile doesn't get a gun

I think the US should restrict gun ownership to those with appropriate training and physological profiling.
Guns arn't toys but they are often treated that way.

Title: Re: Second Amendment News and Views.
Post by: poppo on December 25, 2012, 03:41:19 AM
Ban all guns .... Even if you could there are too many guns in circulation already.

Exactly. This is the number one reason a ban will never work. And since many States (like TX) don't have any registration, there would be no way to ever track most of them down.

Ban full automatics. - a willed person simply orders the conversion parts online - bits of metal are not illegal.

Full-auto guns are already banned in many States, and for those that allow them, there is a lot of red tape to get one and they are very expensive. This is one of the main misconceptions of the anti-gun crowd. They confuse full-auto with semi-auto.

Ban semi automatics - this slows the crazys down but I used to be able to get 10 shots off in 30 seconds using a bolt action 22 hunting gophers.

As noted above, most anti-gun people don't even know what a semi-auto gun is. I can pull the trigger on a revolver just as fast as any semi-auto.

I can buy diesel and fertilizer a lot easier than guns and ammo.
Timothy Mcvay filled up a truck with the above and took out a government building from the street.
I can pull up a lot closer to any school or mall than he ever did.

Yes,  and he killed 168 people, 19 of them children. Where is the call to ban fertilizer, diesel, and trucks?

I think the US should restrict gun ownership to those with appropriate training and physological profiling.

That will not really work as the criminals and those who are unstable will still get them. Here in TX we have to take a course in order to get a concealed carry license. I personally don't have a problem with that as I think people should at least have a basic understanding of the laws, and know which end of the gun the bullets come out of.

That said, I am personally against any mandatory training to own a gun, as that violates our 2nd Amendment right. Those that are legally declareded mentally unstable are already banned from owning a gun. But as noted above, that does not mean they can't still get their hands on one.

The bottom line is no amount of gun laws or bans will stop a lunatic from doing bad things. The only thing it will do is provide more defenseless targets.

I am a democrat and I do not believe in any gun control
The way they should handle crimes that result in bodily injury or death from any weapon is that person spends a long time in prison which at any time the Federal Gov can pursue charges if a gun is used to increase the time spent in jail

Yes I do believe that if more people are allowed to keep guns including at their job, no one would think of attacking a mall, school, post office or the like again.

Australia has very tight gun control and shortly after iwent into effect crime went up by 60 percent, that tells me that gun control does not work.

I even support non violent criminals getting their gun ownership rights fully restored
which they should not have to do anyways
The Second amendment says these rights shall not be infringed
if It was up to me 1968 gun laws and NFA laws would be removed by congress and the president
the reason I say this if some one uses a gun in a crime they better plan on spending at least 20 years in prison making pebbles out of boulders. (or some other work that saves the tax payers money)
if they kill (not justifiable homicide) two or more persons with a gun they get lethal injection within 10 years of conviction.

I also find it pretty hypocritical how the liberals blame Reagan for all the crazies running the street, but they don't want to have anything to do with changing it.  :5-

A LITTLE GUN HISTORY

In 1929, the Soviet Union established gun control.
From 1929 to 1953, about 20 million dissidents,
unable to defend themselves, were rounded up
and exterminated.

In 1911, Turkey established gun control.
From 1915 to 1917, 1.5 million Armenians,
unable to defend themselves, were rounded
up and exterminated.

Germany established gun control in 1938 and
from 1939 to 1945, a total of 13 million Jews and
others who were unable to defend themselves were
rounded up and exterminated.

China established gun control in 1935.
From 1948 to 1952, 20 million political dissidents,
unable to defend themselves, were rounded up
and exterminated.

Guatemala established gun control in 1964.
From 1964 to 1981, 100,000 Mayan Indians,
unable to defend themselves, were rounded
up and exterminated.

Uganda established gun control in 1970.
From 1971 to 1979, 300,000 Christians,
unable to defend themselves, were rounded
up and exterminated.

Cambodia established gun control in 1956.
From 1975 to 1977, one million educated people,
unable to defend themselves, were rounded up
and exterminated.

Defenseless people rounded up and exterminated
in the 20th Century because of gun control: 56 million.

You won't see this data on the US evening news,
or hear politicians disseminating this information.

Guns in the hands of honest citizens save lives
and property and, yes, gun-control laws adversely
affect only the law-abiding citizens.

Take note my fellow Americans, before it's too late!

The next time someone talks in favor of gun control,
please remind them of this history lesson.

With guns, we are 'citizens'. Without them, we are 'subjects'.

I agree with this post only.

Warped people bent on killing will find a way, gun or not.

What happened recently around the country makes me sick. And I can understand those who scream ban the guns. It's an understandable emotional reaction. But of course it would never work.

Constitution Check: Are there no limits on Second Amendment rights?
By Lyle Denniston
Lyle Denniston looks at some recent quotes about the restricted rights from gun owners, which show conflict over the Second Amendment even among people on the same side of the issue.

.THE STATEMENTS AT ISSUE:
“The fact is, all constitutional rights are regulated, always have been, and need to be.”

 – Dick Metcalf, in an article titled “Let’s Talk Limits,” published last October by Guns & Ammo magazine, leading to his firing as a columnist for that publication, as recounted in a story January 5 in The New York Times.

“We are locked in a struggle with powerful forces in this country who will do anything to destroy the Second Amendment.  The time for ceding some rational points is gone.”

 – Richard Venola, a former editor of Guns & Ammo, in a comment quoted by The Times in that same story.

WE CHECKED THE CONSTITUTION, AND…

In only one place in the Constitution’s Bill of Rights is there a provision that flatly bars the government from regulating one of the protected rights.  That is in the First Amendment, declaring that “Congress shall make no law respecting” the rights listed in that Amendment.  The “right to keep and bear arms” is not one of those rights; it is contained in the Second Amendment.

The Second Amendment’s text, of course, does say that the right it protects “shall not be infringed.”  Is that the same thing as saying that government may pass “no law respecting” gun rights?

Let us suppose that, constitutionally speaking, those two phrases do mean the same thing.  But, as history has shown, there if flexibility in constitutional meaning: “No law,” for example, does not really mean “no law.”

The only place that Americans can look for a binding interpretation of what the Constitution’s words mean – other than to the people acting through the amendment process to make a new constitutional declaration – are the decisions of the U.S. Supreme Court.

The reality is that one can look in vain throughout the entire history of the First Amendment for any indication that the rights to religious and press freedom, the right to free speech, and the right to complain to the government about one’s “grievances” are absolute rights, beyond any type of official regulation.

Over the time since 1791, when the Bill if Rights was ratified, the Supreme Court has given its blessing to an entire governing edifice that regulates First Amendment rights: the laws of libel and defamation, limits on publishing secret military strategy, regulation of “obscene” and “indecent” expression, and limits on “hate speech.”  Famously, the court has said that one has no right to shout “Fire!” in a crowded theater.  Even the right to worship freely sometimes is curbed by laws that regulate conduct that has religious meaning.

In contrast to the First Amendment, there is very little constitutional history about the meaning of the Second Amendment.  In fact, until just five years ago, the “right to keep and bear arms” was not generally understand as a personal right to have a gun, even for self-defense.  It was only in 2008 that the Supreme Court declared that such a personal right does, indeed, exist.

That decision, in the case of District of Columbia v. Heller, is – so far – the most important decision the court has ever issued on the scope of the “right to keep and bear arms.”  But in that very ruling, the Court said explicitly: “Like most rights, the right secured by the Second Amendment is not unlimited.”  It went on to say just as clearly that it was not barring the government from imposing “reasonable regulation” on that right.

Is a “reasonable regulation” of gun rights, then, an “infringement” on those rights?  If the word “infringement” means to encroach on something, as one does when one “trespasses” on someone else’s private property, that does not support the idea that Second Amendment rights are absolutes.  Government can “trespass” on private property to put out a fire, for example.

Still, the debate goes on about when, or if, government should have the power to regulate gun rights.  The statements quoted above, from two gun rights enthusiasts, suggest that even within that community, there can be disagreement about whether the time has come to agree on some “rational points” about the Second Amendment.

The Supreme Court, of course, could re-enter into that national debate if it felt a need to clarify just what kind of “regulation” of gun rights is allowed without being found to violate the Second Amendment.

Up to now, however, the Court does not seem to sense that need.  It has issued only one significant gun rights decision since the 2008 ruling, and that 2010 decision in McDonald v. Chicago expanded the personal right to a gun to exist at the state and local level, as well as at the federal level.  The court did not go further to explain what it would allow in gun regulation by state and local governments.

It has been asked, every year since then, to take on a variety of new cases, to answer some of the lingering questions: does the personal right to have a gun extend beyond one’s own home, who can be forbidden to have a gun at all, when can a gun be carried in public in a concealed way, what types of guns or ammunition can be regulated or even banned, what places in a community are too sensitive or too prone to violence to allow guns in them, how can the government trace a gun that has been used in a violent incident, how freely should gun shows be allowed to operate?

However, the Court has resisted giving an answer to any follow-up questions.  And what that has meant, in the national conversation over gun rights, is that anyone’s argument about the extent of those rights is just as good as anyone else’s, and neither side needs to listen to the arguments that the other side makes.

Gun control will go on being an issue in politics and in government, at all levels, but the constitutional rules that could shape how for government may go remain unmade.

Lyle Denniston is the National Constitution Center’s adviser on constitutional literacy. He has reported on the Supreme Court for 55 years, currently covering it for SCOTUSblog, an online clearinghouse of information about the Supreme Court’s work.

If I may, Jay, you're making a couple of mistakes here:
1) You're selecting parts of the document for review instead of reading the document and viewing it as a whole.
2) "Famously, the court has said that one has no right to shout “Fire!” in a crowded theater." Where did you hear this lie?  :5- :200- :96- :25-

That said, y'all can continue to argue about gun control, the 2nd Amendment, laws, etc., just like the politicians want you to, and you'll get nowhere, just like they want you to.  :79-

Schenck v. United States

Quote
The Court, in a unanimous opinion written by Justice Oliver Wendell Holmes, Jr., held that Schenck's criminal conviction was constitutional.

The opinion's most famous and most often quoted passage was this:
The most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic.

Quote
"The most stringent protection of free speech would not protect a man falsely shouting fire in a theater and causing a panic. [...] The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent."

Since we are quoting, there's no reason to not quote accurately. Leaving out the word falsely invalidates the quote :79-

And, the verdict in the Schenk case was later overturned (Brandenburg v. Ohio 1969), by the way...  not to mention that Holmes himself changed his view to be the opposite of what it was initially, in Abrams vs. US.

The new criteria for unprotected speech states that the speech must be directive, and likely to incite imminent lawless action. Since yelling "Fire" in a crowded theater is not directive, it fails the first criteria. So, even correctly quoted, the statement is still false. :186-

The bottom line is that neither the 1st or the 2nd are "unlimited".

From Heller:

Quote
2) Like most rights, the Second Amendment right is not unlimited. It is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose:

Note: I am extremely pro-gun. However there are some extremists that only see "shall not be infringed" and think that means they can own/do whatever they want. On another forum there is at least one person who believes people should be able to own whatever the military has, up to and including nukes.  :25- These extremists who go out of their way to "make a statement" are doing just as much harm as the anti-gun folks. They somehow think that they can force their way of thinking on everyone else.

You and I are of the same opinion, and one has to look no farther than the open carry laws in California to see what negative effects a relatively few extremists can have on our rights.

And yes, I was just busting Jay's balls about the quote... Can't let Buzz have ALL the fun!

But you both have missed the fact that it wasn't Jay who misquoted that line; it was the author of the article he copied/re-posted.

One might argue that if Jay had performed due diligence, he would have seen the error and included [SIC] after the misquote to denote that it was taken verbatim. One might argue that.

However, people who live in stone houses shouldn't throw glasses. Also, people who live in glass houses make interesting neighbors.  :96-

Given the common misuse around here of simple words like "loose" (lo̅o̅s) (meaning 1. Not fastened, restrained, or contained: loose bricks. 2. Not taut, fixed, or rigid: a loose anchor line ..4. Not tight-fitting; not tight: loose slots) when the intended word was "lose" (lo̅o̅z) (meaning 1. To be unsuccessful in retaining possession of; mislay: He's always losing his car keys. ... 4. To fail to win: Did you lose the big game?; I'm losing all my money to this supposedly loose slot machine. :97- )   one might politely suggest that Jay's oversight go unchallenged. One might suggest that.  :30- :200-

I've never been particularly pro gun, but the more the government tries to take our rights away, the more pro gun I get. I hope the billboard owner tells the anti-gun lobby where to get off and sticks to his guns (pun intended).
